These terms explain how Call for Action works, what you can expect from us, and what we ask in return.

These Terms of Service ("Terms") form a legally binding agreement between you ("you," "User") and Call for Action ("Call for Action," "we," "our," or "us"). These Terms govern your access to and use of the Call for Action AI voice-assistant platform, including the website, mobile applications, outbound call agent, telephony services, transcripts, interfaces, and all related products and offerings (collectively, the "Services").

By using the Services, you agree to be bound by these Terms. If you do not agree, do not use Call for Action.

1. Overview of the Service

Call for Action is an AI-powered assistant that can research your political representation, help prepare to make phone calls to your representatives, and make those phone calls providing conversational assistance on your behalf. Call for Action uses AI models, synthesized voices, telephony networks, and third-party systems to perform these tasks.

The Services may interact with organizations, contact centers, and systems that we do not control. We do not guarantee that any specific task, call, outcome, or third-party response will be successful.

2. Eligibility & Account Registration

2.1 Minimum Age

You must be at least 18 years old to use the Services.

2.2 Account Information

You agree to provide accurate, current, and complete information during registration and to update it as needed.

2.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity associated with your account.

2.4 Authority to Act

If you create an account or use the Services on behalf of another individual or entity, you represent that you have proper authority to do so and agree to these Terms on their behalf.

3. How Call for Action Works

3.1 AI Agent & Automated Calling

You acknowledge that you are interacting with an AI system and that:

  • Outputs may contain inaccuracies, misunderstandings, or unexpected results.
  • Political representatives may refuse to interact with automated callers.
  • Call outcomes depend heavily on third-party policies, agent discretion, and the information you provide.

3.2 Your Instructions

Call for Action performs tasks based on information and instructions you provide. You are fully responsible for:

  • The accuracy and completeness of information provided to us;
  • The lawfulness and appropriateness of your requested call;
  • Any consequences arising from incorrect or misleading information.

3.3 Authorization to Act on Your Behalf

By using the Services, you expressly authorize Call for Action to:

  • Communicate with third parties on your behalf;
  • Present itself as acting on your behalf for limited, task-specific purposes;
  • Provide your name or other information when reasonably necessary to complete the task.

All communications made by Call for Action as instructed by you are deemed to have been made with your full knowledge and consent.

3.4 Caller ID Usage

You authorize Call for Action to:

  • Use Call for Action phone numbers or telephony partners' phone numbers when calling;
  • Provide or confirm your phone number to third-party representatives when necessary for verification.

3.5 System Access & Credentials

If you provide login credentials, one-time passcodes, or account-level access, you authorize Call for Action to use secure automated methods to access your accounts solely for task execution.

You remain responsible for the legality and accuracy of information used to access such systems.

4. Acceptable Use

You agree not to use Call for Action to:

  • Engage in unlawful, harmful, fraudulent, threatening, or abusive behavior;
  • Impersonate another person without consent;
  • Conduct high-stakes, high-risk, or regulated tasks (e.g., legal filings, immigration matters, financial transactions, medical decisions) unless we explicitly agree in writing;
  • Submit tasks intended to harass individuals or organizations;
  • Attempt to reverse-engineer, copy, or otherwise misuse our AI, voice, or telephony systems;
  • Overload, bypass, or interfere with our infrastructure.

We may suspend or terminate your access for any misuse.

5. Third-Party Interactions

The Services rely on third-party systems, APIs, telephony carriers, customer-service teams, and other businesses that we do not operate. You acknowledge that:

  • We cannot control or guarantee their availability, responsiveness, accuracy, or cooperation.
  • Outcomes of calls or tasks are not guaranteed.
  • Third-party policies and agents may prevent Call for Action from completing a task.

We are not responsible for the actions or decisions of any third party.

6. User Content

6.1 Input & Output

  • "Input" includes all instructions, data, and content you provide.
  • "Output" includes transcripts, summaries, messages, and other results generated by the Services.

6.2 Our License to Use Content

You grant Call for Action a license to use Input and Output to:

  • Perform and improve the Services;
  • Maintain system safety;
  • Comply with legal obligations.

6.3 Accuracy & Verification

You understand Output may be incomplete, incorrect, or misleading, and you agree to independently verify Output before relying on it.

7. Fees, Billing & Subscription

7.1 Billing

If you purchase paid features or subscriptions:

  • Fees are charged in accordance with the pricing in effect at the time of purchase.
  • Subscriptions renew automatically at the end of each billing period until cancelled.
  • You authorize us, or our payment processor, to charge your designated payment method for all applicable fees.
  • You are responsible for keeping your billing information accurate and up to date.
  • Applicable taxes may be added to the amounts charged.

7.2 Refunds

Except where required by law, payments are non-refundable.

7.3 Changes to Pricing

We may modify pricing with at least 30 days' notice before renewal.

8. Termination

We may suspend or terminate your account if:

  • You violate these Terms;
  • Your use creates risk or harm to Call for Action or others;
  • Required by law.

You may stop using the Services at any time. Termination does not relieve you of outstanding payment obligations.

9. AI & Telephony Disclaimers

Call for Action is provided as an AI-based assistance tool. You acknowledge:

  • AI may misunderstand or misinterpret information;
  • Call outcomes depend on human agents and systems outside our control;
  • Call for Action does not provide legal, medical, financial, or professional advice;
  • Call for Action cannot guarantee accuracy, success, or any specific result;
  • You must independently verify any important information communicated by Call for Action.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CALL FOR ACTION DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

We do not guarantee that:

  • The Services will be uninterrupted or error-free;
  • Third-party systems will cooperate;
  • Output will be accurate, complete, or reliable;
  • Your tasks will achieve any specific outcome.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • CALL FOR ACTION WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.
  • OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID IN THE THREE MONTHS PRECEDING THE CLAIM, OR (B) $100.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum amount permitted by law.

12. Indemnification

You agree to indemnify and hold harmless Call for Action, its officers, employees, contractors, and affiliates from any claims, damages, losses, or expenses arising from:

  • Your use of the Services;
  • Your Input or Output;
  • Your instructions;
  • Your violation of these Terms;
  • Any third-party dispute caused by your information, identity, or instructions.

13. Dispute Resolution & Arbitration (U.S. Users)

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.

13.1 Mandatory Informal Resolution

Before filing any claim, both parties must attempt to resolve disputes informally for at least 60 days.

13.2 Agreement to Arbitrate

Except for small-claims matters, you and Call for Action agree to resolve disputes through binding individual arbitration, not in court.

13.3 Class Action Waiver

You and Call for Action agree that:

  • Claims must be brought individually;
  • No class actions, class arbitrations, or representative actions may be pursued.

13.4 Opt-Out

You may opt out of arbitration within 30 days of first accepting these Terms by emailing: [email protected]

14. Changes to the Terms

We may update these Terms from time to time. Material changes will include advance notice. Continued use constitutes acceptance.

15. Privacy

Our Privacy Policy explains how we handle personal data. By using the Services, you acknowledge that we may process personal data as described in the Privacy Policy. If you choose to enroll your own voice for use in calls, additional terms governing voice biometric data are set out in our Voice Consent Policy.

16. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflicts of law principles, except where preempted by U.S. federal law.
