Reform FISA Section 702 to Stop Warrantless Government Surveillance
A powerful government surveillance law is up for renewal — and without meaningful reform, it could be used to monitor everyday Americans without a warrant. Section 702 of the Foreign Intelligence Surveillance Act (FISA) allows U.S. intelligence agencies to collect communications data from foreign nationals on American soil, but its broad reach has repeatedly swept up the private communications of U.S. citizens in the process — all without a court order.
Originally passed in 2008, Section 702 was built with a sunset clause to ensure Congress would periodically revisit the law as technology evolved. Yet despite decades of rapid change — from smartphones to AI-powered data mining — few meaningful reforms have been made. In April 2024, Congress passed the Reforming Intelligence and Securing America Act (RISAA), which actually expanded FISA's reach rather than reining it in. Now, lawmakers are weighing another extension via H.R. 8035, and the White House is pushing for a clean reauthorization with no strings attached. As of late April 2026, Congress passed a 45-day extension through June 12th, buying time for reform negotiations to continue.
The stakes are high. The FBI has already exploited Section 702 loopholes to access the communications of peaceful protesters, journalists, elected officials, campaign donors, and even a judge who reported police misconduct. More than 100 civil liberties organizations have warned Congress that emerging technologies like artificial intelligence will only multiply the opportunities for abuse — enabling the government to mine and sell personal data at an unprecedented scale.
Congress must not hand the government a blank check for surveillance. Any reauthorization of Section 702 must include strong warrant requirements and robust reforms that bring the law in line with modern technology and constitutional protections.
