Protect Voting Rights and Fair Representation
In a landmark 6-3 ruling on April 29th, the Supreme Court dealt a severe blow to voting rights in America. The decision in Louisiana v. Callais, split along ideological lines, effectively guts Section 2 of the Voting Rights Act (VRA) — the provision that protected communities of color from discriminatory electoral rules and the dilution of their political power. In her dissent, Justice Elena Kagan warned that the ruling now allows states to systematically strip minority voters of their representation without legal consequence.
The fallout has been swift. Several southern states — including Tennessee, Alabama, Mississippi, and South Carolina — have moved quickly to take advantage of the weakened protections. Louisiana's governor even suspended an ongoing primary election in response to the ruling. A separate decision by the Virginia Supreme Court striking down a voter-approved congressional map has further underscored how fragile fair representation has become across the country.
Congress has tools available to fight back. Democrats have reintroduced the John Lewis Voting Rights Advancement Act, which would restore and strengthen the core safeguards that the VRA originally provided. The Freedom to Vote Act — not yet reintroduced this congressional term — would go further by banning partisan gerrymandering, expanding ballot access, and blocking election denial tactics. Lawmakers and legal experts have also proposed a range of Supreme Court reforms, including 18-year term limits for justices, expanding the size of the Court, and restricting the use of the "shadow docket" to limit rulings made outside of normal legal proceedings.
