Oppose Federal AI Preemption

Over 30 states have taken meaningful steps to protect their residents from the risks of artificial intelligence — passing laws that address everything from AI-generated deepfakes to nonconsensual imagery and child exploitation material. Now, there are active efforts in Congress and from the executive branch to preempt those protections.

Congressional efforts have included a proposed 10-year moratorium on state AI laws in H.R. 1 and similar language attached to the National Defense Authorization Act (NDAA). In December 2025, President Trump signed an executive order aimed at nullifying state AI laws, despite questions about whether the executive branch has the legal authority to do so. The order would also create an 'AI Litigation Task Force' to challenge states with AI regulations and threaten to cut off federal broadband funding to states that do not comply.

A federal ban on state AI regulation would remove consumer protections that states have carefully crafted, potentially handing significant advantages to large technology companies. Without these guardrails, harmful AI applications could proliferate with limited accountability.

Congress should reject any legislative effort to preempt state AI laws and instead pursue strong, effective federal regulation that protects consumers.
