Oppose the Repeal of Section 230 — Protect Free Speech Online
Section 230 of the Communications Decency Act is the legal backbone of the free and open internet. For decades, it has shielded online platforms from being held liable for content posted by their users — making it possible for forums, comment sections, product review pages, and social media communities to exist in the first place. Now, a bipartisan effort in Congress is pushing to let that protection expire on January 1, 2027.
Senators Dick Durbin (D-IL) and Lindsey Graham (R-SC) are leading the charge to repeal Section 230, arguing that setting a hard deadline will push Big Tech companies to negotiate new legislation. But that logic puts everyday internet users at serious risk. Large corporations have the legal resources and deep pockets to weather increased litigation — smaller platforms, independent forums, and community spaces do not. If Section 230 disappears without a strong replacement, countless online communities could be forced to shut down or severely restrict what users can say.
There is currently no agreed-upon alternative that would preserve civil liberties while replacing Section 230's protections. Letting the provision simply expire would create a legal vacuum with enormous consequences for free expression online. Congress should not gamble with the foundations of the open internet on the hope that Big Tech will voluntarily propose something better.
