No War With Iran — Demand Congress Assert Its Constitutional Authority
On February 28, 2026, the Trump administration partnered with Israel to launch military operations against Iran without any authorization from Congress — killing Iran's Supreme Leader and drawing multiple countries into armed conflict. Under Article 1, Section 8 of the U.S. Constitution, only Congress has the power to declare war. Trump bypassed that authority entirely, and the consequences have been severe: hundreds of deaths from airstrikes, over twenty Iranian ships sunk in international waters, the use of AI-assisted warfare, and the loss of American service members.
Both chambers of Congress attempted to push back. The Senate considered war powers resolution S.J.Res. 123, which failed 47–52 on April 15, 2026. The following day, the House voted down its companion resolution, H.Con.Res. 40, by the narrowest of margins — 213 to 214. These resolutions would have reasserted Congress's constitutional war-making authority, but they fell short. Meanwhile, Trump has made alarming threats to "obliterate a whole civilization" if Iran does not comply with his demands — language that many experts and lawmakers have described as genocidal.
Although Trump announced a two-week ceasefire in early April, violations have already been alleged by both sides, and the broader damage to global security and economies continues. Experts warn that the vague, shifting justifications for this conflict risk turning it into another open-ended "forever war." There are also growing concerns that Trump will seek emergency military funding from Congress — even as domestic programs face devastating cuts — to sustain operations with no defined mission or exit strategy.
Congress must use every tool at its disposal to rein in this unauthorized war. That means supporting war powers resolutions, holding aggressive public oversight hearings, refusing to fund unauthorized military action, and holding the President accountable for his defiance of the Constitution.
